These Terms of Service ("Terms") govern your use of the website located at www.jenloyerboudoir.com and your engagement with the photography services provided by Jen Loyer Boudoir LLC ("Company," "we," "us," or "our"). By accessing this website or booking services with us, you agree to be bound by these Terms. If you do not agree, please do not use this website or book our services.

1. SERVICES
Jen Loyer Boudoir LLC is a professional boudoir photography studio located in Prescott, Arizona. We provide in-studio boudoir photography sessions, image products, and related services to clients 18 years of age or older. All services are subject to availability and are confirmed only upon receipt of a non-refundable retainer and execution of a client agreement.

2. ELIGIBILITY
You must be at least 18 years of age to book or receive services from Jen Loyer Boudoir LLC. By booking a session, you confirm that you meet this age requirement. We reserve the right to request valid government-issued photo identification at any time.

3. BOOKING AND RETAINER
A non-refundable retainer is required to secure your session date. No session date is held or considered confirmed until the retainer has been received. The retainer amount and any applicable credit toward a collection purchase will be specified in your client agreement. The retainer is earned upon receipt and is non-refundable under any circumstances.

4. PAYMENT
All payments made to Jen Loyer Boudoir LLC are non-refundable. This includes the retainer, collection payments, product payments, and any other fees paid at any stage of the booking and session process.
Clients are required to pay in full prior to their session date using one of the following options:
• Pre-Session Payment Plan (PSPP): A structured installment plan with all payments completed prior to the session date, as outlined in the client agreement.
• Payment in Full: Full payment of the selected collection due no later than 30 days prior to the session date.
No payment plans or installment arrangements are available after the session date. All balances must be paid in full before images are delivered, digital files are released, or products are ordered. Jen Loyer Boudoir LLC reserves the right to withhold all deliverables until payment is received in full.

5. CANCELLATIONS, RESCHEDULING, AND NO-SHOWS
All payments are non-refundable regardless of the reason for cancellation, including personal emergencies, illness, or change of plans.
Rescheduling requests must be submitted at least 72 hours prior to the session date. Rescheduling is subject to availability and is not guaranteed. A rescheduling fee may apply as outlined in your client agreement.
Cancellations made less than 72 hours before the session date and no-shows will result in forfeiture of all payments made to date, including the retainer and any collection payments. No exceptions will be made.
In the event that Jen Loyer Boudoir LLC must cancel or reschedule your session, we will offer rescheduling at no additional charge. If rescheduling is not possible, your retainer will be refunded.

6. IMAGE OWNERSHIP AND LICENSING
All images created during your session are and remain the exclusive intellectual property of Jen Loyer Boudoir LLC, protected under United States copyright law. Purchasing a collection does not transfer copyright ownership.
Upon full payment, clients receive a personal, non-transferable, non-commercial license to use their purchased images for personal enjoyment only. Images may not be reproduced for commercial purposes, sold, licensed to third parties, or used in any way beyond personal use without the express written consent of Jen Loyer Boudoir LLC.

7. MODEL RELEASE AND IMAGE SHARING
Jen Loyer Boudoir LLC will not share, publish, display, reproduce, or use any client session images for portfolio, website, social media, marketing, advertising, or any other public-facing purpose without a separately executed, signed model release.
Signing a model release is entirely voluntary and will never be required as a condition of booking, service, or image delivery. Clients who choose to sign a model release may do so at any time and may specify limitations on how their images may be used.

8. CONDUCT AND SAFETY
Jen Loyer Boudoir LLC reserves the right to terminate a session at any time if a client engages in behavior that is abusive, threatening, or disruptive to the safety or comfort of any person present. In such cases, all payments are forfeited and no images will be delivered.

9. PROMOTIONAL OFFERINGS
Jen Loyer Boudoir LLC may periodically offer promotional session opportunities, including but not limited to model calls, discounted sessions, and giveaways, at adjusted rates or modified terms. The specific terms, pricing, eligibility requirements, and conditions of each promotional offering will be communicated at the time of the offer. Promotional terms supersede these general Terms where applicable.

10. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Jen Loyer Boudoir LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.

11. PRIVACY

12. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or our services shall be resolved in the state or federal courts located in Yavapai County, Arizona, and you hereby consent to personal jurisdiction in those courts.

13. CHANGES TO THESE TERMS
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated effective date. Your continued use of our website or services following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

14. ENTIRE AGREEMENT
These Terms, together with your signed client agreement and our Privacy Policy, constitute the entire agreement between you and Jen Loyer Boudoir LLC with respect to your use of our website and services, and supersede all prior agreements and understandings.
